Canada’s Provincial Nominee Program (PNP) has long been a vital pathway for skilled individuals seeking permanent residency, enabling provinces to address specific economic and labor market needs. However, an article published by The Toronto Star, titled “Provincial immigration applicants in Canada see soaring processing times. They say the system is unfair,” sheds light on a troubling trend: significant delays in application processing that are raising questions about fairness and efficiency within the immigration framework.

We have noticed this trend with our own Ontario Immigrant Nominee Program (OINP) clients, who used to obtain Nomination Certificates within 3 to 5 months, now waiting over a year for an Invitation to Apply, if they receive one at all.

Under the PNP, provincial governments nominate candidates for permanent residency, subject to final approval by Immigration, Refugees and Citizenship Canada (IRCC). While the program is designed to facilitate a relatively expedient transition to permanent status, the article reveals that many applicants are encountering wait times far exceeding the anticipated six-month benchmark—some extending upwards of 18 months or more. Such delays are not only disrupting applicants’ professional and personal plans but also imposing considerable financial burdens as individuals navigate temporary statuses or support dependents abroad.

We also note that in the case of Ontario, the National Occupation Classification system numbers chosen (each job title has a corresponding NOC number) have narrowed, and NOC numbers previously selected are being left out, leaving applicants in limbo.

Experts attribute these prolonged processing times to a surge in application volumes, insufficient staffing at IRCC (the department recently announced they were firing 3,300 workers, or 20% of their staff), and a lack of clarity regarding prioritization protocols. Notably, the disparity between PNP processing timelines and those of other immigration streams, such as Express Entry, has fueled allegations of inequity, prompting calls for reform.

From a legal perspective, these delays underscore potential deficiencies in administrative fairness and procedural accountability. Applicants, having complied with stringent eligibility criteria, are entitled to reasonable expectations of timely adjudication. The absence of transparent communication and predictable timelines risks eroding confidence in the immigration system—a system Canada promotes as efficient and welcoming, but which is no longer the case.

We need to increase IRCC’s staff, streamline workflows, and add greater accountability from IRCC and the PNP offices. Without such interventions, the mounting backlog threatens to further undermine Canada’s already damaged reputation as a premier destination for global talent.
