Overview of the Entry/Exit Program

The Entry/Exit Program is designed to record the biographic information of travelers as they enter and exit Canada. This data includes personal details such as name, date of birth, nationality, and travel document information.

Mechanisms of Data Collection

The program operates through a bilateral information-sharing agreement between Canada and the United States, as well as direct data collection by the CBSA:

  • Land Borders: At land ports of entry, the entry record into one country serves as the exit record from the other. This reciprocal exchange allows both nations to maintain accurate records of cross-border movements.
  • Air Travel: For air travelers, commercial air carriers are mandated to provide exit information to the CBSA within 72 hours of a flight’s departure. This data encompasses flight details, departure times, and passenger information.

It’s important to note that, as of now, the program does not encompass marine and rail exits.

  • Canadian Citizens and Permanent Residents: The program assists in verifying residency requirements for citizenship applications and the renewal of permanent resident cards. Accurate exit data ensures that individuals meet the necessary physical presence criteria stipulated by Canadian immigration laws.

  • Temporary Residents: For individuals on temporary visas, such as students or workers, the program monitors compliance with visa conditions, including the duration of stay and adherence to authorized activities.

Exit data can influence the validity of work permits and future immigration applications. Non-compliance can lead to legal repercussions and affect the organization’s ability to hire international talent.

Entry/Exit program use

IRCC obtains Entry/Exit information, via GCMS, from the Canada Border Services Agency (CBSA). Entry/Exit information can be used to support the administration of the Immigration and Refugee Protection Act (IRPA), the Citizenship Act and the Canadian Passport Order by allowing IRCC users to

  • verify residence requirements in support of applications for grants of citizenship (CIT) or permanent resident card applications
  • verify that sponsors are residing in Canada
  • verify the residence of spouses and partners under the spouse or common-law partner in Canada class
  • support investigations of possible fraud in relation to immigration, citizenship, and passport/travel document programs.

Privacy and Data Protection

The collection and use of personal data under the Entry/Exit Program are governed by strict privacy laws. The CBSA ensures that access to this information is limited to authorized personnel and is used solely for purposes outlined in the Customs Act. Individuals have the right to request access to their personal information and seek corrections if necessary.
